Legal & Intellectual Rights Framework

Copyright & Permissions.

Susruta Publishing House establishes balanced copyright policies that protect author intellectual ownership, define commercial digital licensing, and clarify protocols for utilizing third-party scholarly materials.

Scholarly copyright law volumes, legal protections, and intellectual licensing
Intellectual Integrity Author Rights • Exclusive Publishing License • Fair Clearance

◈ 1. Author Intellectual Ownership

At Susruta Publishing House, we believe authors must retain moral and intellectual ownership of their scholarship. Unlike legacy commercial models that mandate full transfer of all underlying copyright, SAPH guarantees that the fundamental copyright of the original intellectual content remains vested in the author(s) or editor(s).

Moral & Paternity Rights The author retains perpetual moral rights to be named and acknowledged as the creator of the work across all published editions, translations, and digital adaptations.
Educational & Coursepack Reuse Authors retain the right to reuse their own published chapters, figures, or portions of their monographs in their ongoing classroom teaching, coursepacks, or lectures without fee.
Patent & Formulation Protections: Publishing a scholarly treatise, clinical observation, or pharmaceutical preparation analysis with SAPH does not surrender any underlying patentable rights or proprietary medical formulations held by the author or their sponsoring institution.

◈ 2. Exclusive Publishing License

Upon formal acceptance of a book proposal or completed chapter manuscript, authors execute our standardized Publishing Agreement. Under this agreement, authors grant Susruta Publishing House an exclusive, worldwide license to produce, typeset, register, and distribute the final work in electronic and digital-first editions.

This publishing license authorizes SAPH to:

  • Register dedicated e-ISBNs with national and international cataloging registries.
  • Typeset, format, and generate digital master files (Academic PDF, EPUB, and XML).
  • Distribute digital editions globally to institutional university repositories, academic libraries, and scholarly book aggregators.
  • Defend the published edition against unauthorized pirated distribution, uncredited digital mirroring, and commercial infringement.
"The author grants Susruta Publishing House the exclusive right to publish, produce, typeset, display, archive, and distribute the work in digital formats worldwide for the legal duration of copyright."

◈ 3. Third-Party Permissions & Clearance

Authors bear legal and ethical responsibility for ensuring that all submitted text, anatomical plates, clinical photography, historical manuscript scans, and complex tables do not infringe upon any third-party copyright.

When Written Permission is Mandatory Direct quotation of extended prose (>300 words), reproduction of proprietary medical illustrations, anatomical line drawings from copyrighted modern journals, or copyrighted clinical photographs.
Public Domain & Classical Treatises Classical Sanskrit Samhitas and ancient manuscript texts in the public domain do not require copyright licenses; however, exact translations authored by modern scholars remain copyrighted and require formal credit or clearance.
Submission Proof Required: Proof of written permission from the original copyright holder must be provided at the time of final manuscript delivery. Any associated licensing fees charged by third-party rights holders are the responsibility of the author.

◈ 4. Self-Archiving & Institutional Repositories

SAPH promotes the legitimate dissemination of research while protecting the integrity of the published Version of Record (VoR).

  1. Pre-Print (Author's Original Manuscript): Authors may share their initial unrefereed draft on non-commercial preprint servers prior to formal peer review, provided SAPH is noted as the intended publisher.
  2. Accepted Manuscript (Post-Peer Review): Following acceptance and formal peer review, authors may deposit the peer-reviewed draft in their institutional university repository under a standard 12-month embargo period.
  3. Final Published Edition (Version of Record): The finalized, typeset PDF/EPUB featuring official SAPH branding, ISBN, and page layout cannot be uploaded to public commercial platforms (e.g., Academia.edu, ResearchGate) without prior written authorization or an Open Access publishing agreement.

◈ 5. Requesting Permissions to Reuse SAPH Content

Parties seeking permission to reproduce, translate, or adapt excerpts, figures, or entire chapters from any Susruta Publishing House monograph must transmit a formal request to our permissions desk.

Requests must detail:

  • Exact publication title, author/editor names, and registered ISBN.
  • Specific chapter title, page numbers, and figure numbers requested.
  • Proposed venue of reuse (e.g., forthcoming academic book, doctoral dissertation, translated textbook).
  • Publisher name, format (print, digital, or both), and estimated publication date.

All inquiries should be submitted in writing to: susrutaayurveda@gmail.com with the subject line "Permissions & Rights Clearance Request".
